Your maid has to go back to philippines & u can apply for a new permit under your name after the current work permit expires. U need an agent in philippines who can do the paperwork for u. Then u also need an agent in malaysia to bring her in & apply her work permit (this is a requirement by our malaysia government). For filipinos maids, employers cannot apply work permits for maids by themselves. Also please take note that there is a cooling off period of 3 months after she goes back to philippines when her permit expires. During cooling off period, she can't come into malaysia.CThttps://www.blogger.com/profile/08131710534702851460noreply@blogger.comtag:blogger.com,1999:blog-7441597340084246695.post-83355133063195105962015-02-18T14:00:13.427+08:002015-02-18T14:00:13.427+08:00Hi Ct,

I am in a little bit of a pickle. My filipino maid has been with us for 3 years and we love her dearly.
He visa is expiring next month and we would like to renew her ourselves without an agent as our agent wants to charge us RM9000. The situation is that our maid initially came in as a tourist visa under the instruction of the agent. She then work for a family for 3 month whilst her work visa is in process under the agency name or/principle (bogus) Then she came to us to work. And only recently when we wanted to renew her work permit we realised that her permit & contract was under someone elses name. So the agent says the only way to renew her permit is through them.
We would like her to work with us long term and we want to do it right. She is now scheduled to go back Phillipines when her visa expire next month. How should we proceed to ensure that her permit is under us so it would be easy for future renewal. Also how do we apply for her ourselves without an agent and from Phillipines. Thanks for your help. My employer under my permit is not my actual boss here in office they just ask some one to act as my employer which is also under the company where i work right now. And my original passport is not me, they keep it. Now my problem is I'm not happy anymore working with them, but i can not just get away from them because my passport is not with me. So now i met one employer who is willing to hire me. Now i"m making a plan but i don't know if it will work out, i want to do lost passport in my own, but I'm scared if I do the police report maybe the police officer will need my acting employer, or it is possible to just get some one to represent my employer to do filing of a police report? Affidavit of loss as well? where can i get this it is necessary also my acting employer will get for me or can i get it by my own.. and more thing is need an Employment Contract I have my employment contract anyway but the problem is not original it is necessary the original? I don't want to let anyone of my colleague know about this and i don't want to talk to my boss regarding this as well i want to do my own action with out their knowing and maybe if i have my new passport i can go away with them already. If your maid is an indon instead of filipino, then you might be able to file for almost full refund since there is a MoU signed (read this: http://www.themalaysianinsider.com/malaysia/article/agencies-must-replace-maids-for-unsatisfied-employers-says-subra).

Refund policy is very vague in Malaysia. Rm6k is too much for replacement.

No, u cannot choose 1.5 years. That's because every new maid's work permit is given per year basis. So when your new replacement is here, her permit is approved for 1 year from her arrival date. After 1 year, agent will renew her permit for 1 more year. That makes up the contract for 2 years. But work permit is yearly basis regardless the contract duration. Unless you tell your agent you need just 1 year of service from the replacement maid. If she is good, you can do her renewal yourself (thru online) & it cost only RM516 for 1 year of permit.

Refund amount is just too little. Either way, you're at a loss. Try asking for more refund or asking for lower agent fee if you want the 1 year replacement option instead of 2 years. To send her back with her own cost. But I have handed over the maid to the agent. I think they will recycle her. I'm pity the next employer to have such incompetence maid (obviously her motive is not genuine).

Now, the agent gave me two options:
1) Refund RM1000 to RM2000 and we no need their service anymore.
2) Replace a maid with this fee:
- RM2223 replacement fee (includes: insurance, air-ticket, levy)
- Pro-rated Agent Fee RM300 x 6month = about RM1840 (they said another 2 years contract, so have to extend 6 months)
- New maid salary advance for RM600 x 4 months.
Total: RM6460.

The new maid salary advance (RM600 x 4months) is given to agent to hold the maid's salary. So, employer only need to pay RM600 for the first four months to the maid. If the maid managed to finish the 2 years contract, the agent will give it to back them. Else, will be burn & kept by agent.

For my case, I still torn between to replace or not. Actually, I am not so desperate having a maid, because I realised I am in a very risky side based on the contract with this agent.

FYI, if I ask them to replacement maid and I paid RM6460 to them. The agent will not give us any warranty next time. So, if my 2nd maid want to resign/run away/under-perform after 1 WEEK or 2 months, the agent will not be responsible to replace a maid for us.

So, I think I don't agree on the advanced salary part. Why the agent want to hold maid's money if they unable to give any warranty to us? Shouldn't be employer hold the money would be better right?
And why they charge Pro-rated agent fee while I don't have confident the next maid will work for me for 2 years. Can I just ask to remain same contract to continue the 1.5year term?

I feel that they took advantage on my situation. I either have to pay even more to get a maid (with such a high risk), Or I face almost total lost if don't want to proceed (RM1000 to RM2000 refund)

The agent also cannot assure that the next maid is competence or not. (I felt like they can just hiring ANY LIVING PERSON that is willing to travel here).
Competent or not, is just based on employer's luck.

Do you think paying RM6460 is required?
Anonymousnoreply@blogger.com
